You must not attempt to gain unauthorised access to any part of the website or introduce viruses, malicious code or other harmful technology.
We reserve the right to refuse access to our website or services where we reasonably believe these Terms have been breached.
3. INFORMATION ON THIS WEBSITE
We do our best to ensure that information on this website is accurate and up to date.
However, information may occasionally contain errors or become outdated.
We reserve the right to correct errors, update information, change descriptions and amend or discontinue products or services at any time.
Business advice, resources, blogs and other information provided through Pink Gorilla Media are intended as general business guidance. They should not be treated as legal, financial, tax or other regulated professional advice.
4. PRICES AND PAYMENT
Prices are displayed on the relevant product or service page.
We reserve the right to change our prices at any time. Any price change will not affect an order that has already been accepted unless otherwise agreed with you.
Payment must be made using one of the payment methods available at checkout.
Where a payment plan is available, the details will be shown on the relevant product or service page or agreed separately before purchase.
You are responsible for providing accurate billing and contact information.
5. 1:1 SESSIONS
Where you purchase a Clarity Hour, Website Clarity Hour or another 1:1 service, you may be asked to complete a questionnaire or provide information before our session.
This allows us to use our time together effectively.
You are responsible for providing accurate information and attending the agreed appointment.
Advice and recommendations are based on the information available to us at the time.
While we will provide practical advice, ideas and recommendations, we cannot guarantee particular financial, business, marketing or sales results.
Your results will depend on many factors, including the decisions you make and the actions you take following our work together.
6. WEBSITE SERVICES
Where you purchase a website build, review or related website service, the exact work included will be described on the relevant product page or agreed with you before work begins.
For website builds, you are responsible for supplying requested information, branding, photographs, product information, copy and other materials unless we have specifically agreed to create them for you.
Delays in supplying these materials may delay completion of your website.
The £500 Business Website and other fixed-price website packages include only the work stated in the relevant product description.
Additional pages, functionality, integrations, copywriting, ecommerce, booking systems or other work outside the agreed scope may incur an additional charge.
We will tell you before carrying out additional chargeable work.
Unless otherwise stated, website builds include the number of revisions specified on the product page. Additional substantial changes may be charged separately.
7. WEBSITE PLATFORMS AND THIRD-PARTY COSTS
Some services may require third-party platforms, software or subscriptions.
These might include website platforms, domains, email marketing services, booking systems, ecommerce platforms, apps or other software.
Unless specifically stated as included, third-party fees, subscriptions, domain charges and ongoing platform costs are your responsibility.
We are not responsible for changes, outages, pricing changes or technical problems caused by third-party services.
8. CLIENT RESPONSIBILITY FOR WEBSITE CONTENT
You are responsible for ensuring that any text, photographs, logos, graphics, trademarks or other materials you provide to us can legally be used.
By supplying content to Pink Gorilla Media, you confirm that you own it or have permission to use it.
You are also responsible for checking the final website content, prices, contact information, policies and other important business information before launch.
Where appropriate, you are responsible for ensuring your website has suitable legal documents and complies with laws and regulations applicable to your particular business.
9. DIGITAL PRODUCTS AND DOWNLOADS
Some Pink Gorilla Media products are supplied digitally.
Digital products are for your personal or business use only unless the product specifically states otherwise.
You must not copy, reproduce, resell, distribute, share or commercially exploit our digital products, templates, resources, workshop materials or other intellectual property without written permission from Pink Gorilla Media.
Your cancellation and refund rights for digital content may differ once you have begun downloading or accessing that content. Please refer to our Refund Policy and the information provided at checkout.
10. MEMBERSHIPS AND ONGOING SERVICES
Some services may operate on a recurring subscription or monthly basis.
The price, billing frequency and cancellation arrangements will be explained before you purchase.
Where a service can be cancelled at any time, cancellation prevents future payments but does not normally refund a period of membership or support that has already begun, subject to your statutory rights.
We reserve the right to change, replace or reschedule individual sessions, workshops or features within an ongoing programme where reasonably necessary.
11. CANCELLATIONS AND RESCHEDULING
If you need to reschedule a booked 1:1 session, please give as much notice as reasonably possible.
Repeated cancellations, missed appointments or very late cancellations may result in the session being treated as used.
If Pink Gorilla Media needs to cancel or rearrange a session, we will offer an alternative date.
Any applicable cancellation or refund rights are also subject to our Refund Policy and your statutory consumer rights.
Nothing in these Terms affects rights you have under applicable consumer law.
12. REFUNDS
Refund eligibility depends on the product or service purchased and whether work, access or delivery has already begun.
Please read our Refund Policy before purchasing.
Nothing in our Refund Policy or these Terms limits any statutory rights that cannot legally be excluded.
13. BUSINESS RESULTS
We genuinely want the work we do together to make a difference to your business.
However, we cannot guarantee increases in followers, website traffic, enquiries, sales, income or profit.
Business performance depends on numerous factors outside our control.
Testimonials and examples shown on this website represent individual experiences and should not be interpreted as a guarantee that every customer will achieve the same results.
14. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of this website and materials created by Pink Gorilla Media, including text, graphics, branding, resources, downloads, training materials and original content, belong to Pink Gorilla Media or are used with permission.
You may not reproduce, distribute, resell or commercially exploit this material without our written permission.
Where we create a website or other bespoke work for you, ownership and usage of the final work will be subject to the terms agreed for that particular service and any rights belonging to third-party platforms, fonts, photographs, software or other licensed materials.
15. THIRD-PARTY LINKS AND SERVICES
Our website may contain links to third-party websites, platforms, apps or services.
We are not responsible for the content, availability, security, policies or practices of third-party websites or services.
You should review the relevant third party's terms and privacy policies before using their services.
16. REVIEWS, COMMENTS AND FEEDBACK
If you provide a review, testimonial or other feedback, you remain responsible for what you submit.
We may ask for permission to use testimonials or feedback in our marketing, website or social media.
We reserve the right to remove comments or content submitted to our website that are unlawful, abusive, misleading, offensive or infringe another person's rights.
17. PERSONAL INFORMATION
How we collect, use and protect personal information is explained in our Privacy Policy.
By using our website or purchasing from us, you acknowledge that personal information may be processed where necessary to provide the service, process payments, communicate with you and operate the website.
18. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.
To the extent permitted by law, Pink Gorilla Media will not be responsible for indirect or consequential losses arising from the use of our website, products or services.
We are not responsible for losses resulting from circumstances outside our reasonable control, including failures or changes to third-party platforms and services.
19. REFUSAL OR TERMINATION OF SERVICES
We reserve the right to refuse or terminate a service where there has been serious or repeated breach of these Terms, abusive behaviour, non-payment, unlawful activity or another reasonable basis for ending the working relationship.
Where appropriate, we will communicate this to you and deal with any outstanding work or payments in accordance with these Terms and applicable law.
20. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our services, website, business or legal requirements.
The latest version will be published on this page.
Changes will not retrospectively remove statutory or contractual rights that have already arisen.
21. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have rights under the laws applicable where you live that cannot legally be excluded by these Terms.
